1. Acceptance of Terms & Operator Agreement
By accessing, registering for, or utilizing the Trevak mobile application, website, native watch applications, and related telemetry services (collectively, the "Service"), you agree to be legally bound by these Terms of Service. If you do not agree to all terms and operating conditions, you may not access or use the Service.
2. The Medical Prohibition & Semantic Air-Gap (Rule 1 & Rule 2)
Trevak is strictly a mathematical telemetry and biomechanical modeling tool. Trevak is not a licensed physical therapist, medical provider, or licensed healthcare facility, and the Service does not constitute Software as a Medical Device (SaMD).
- Zero Diagnostics: Trevak does not diagnose, treat, cure, prevent, or heal any physiological disease, pathology, or medical condition.
- Probabilistic Language: All biomechanical outputs, foam compaction rates, thermal work strain scores, and strike balance analytics are algorithmic estimations, data-driven modeling, and suggestive advisories.
- User Agency: The system provides telemetry data, but you (the operator) retain 100% agency over your training schedule, physical exertion limits, and equipment replacement decisions. Always consult a licensed medical professional before altering your athletic routine.
3. Situational Awareness & Safety Radar Limitations (Rule 4)
Trevak features a Real-Time Safety Radar and atmospheric weather advisories. These tools are strictly designed for situational awareness and telemetry sharing among authorized squad members.
Under no circumstances is Trevak a replacement for emergency services (911/112), professional weather broadcasting networks, or dedicated SOS satellite beacons (such as Garmin InReach). Trevak LLC disclaims all liability for injuries, accidents, or environmental hazard exposures sustained while operating the Service.
4. E-Commerce Requisition & FTC Affiliate Disclosures (Rule 13)
Equipment listed in the Quartermaster Storefront or Armory is categorized strictly as "athletic tools" or "mechanical support."
Trevak participates in direct e-commerce (Violet.io) and affiliate program networks (such as Amazon Associates). When you click outward links or procure gear through the Service, Trevak may earn affiliate referral commissions. In compliance with trademark regulations, all public marketing mockups utilize legally distinct, in-universe generic callsigns ("Carbon Racer Elite").
5. FTC Promotional Disclosure Guidelines for Alpha Testers (Item L-10)
If you participate in Trevak testing cohorts, receive complimentary equipment, or earn a digital Vanguard Badge and post reviews, photos, or telemetry publicly on social media or forums:
#TrevakTester, #ComplimentaryProduct, or Complimentary gear received for beta testing).The Vanguard Badge and other challenge badges are digital in-app rewards with no cash value, are not transferable, and are not redeemable for physical merchandise unless Trevak later announces a separately reviewed fulfillment program.
6. Age Eligibility (COPPA 13+) & Account Security
You must be at least 13 years of age to register for or use Trevak. In compliance with the Children's Online Privacy Protection Act (COPPA), Trevak does not knowingly collect data from children under 13.
You are responsible for maintaining the confidentiality of your login credentials and Squad Codes. Trevak employs strict Row-Level Security (RLS) to enforce athlete data isolation.
7. Governing Law & Intellectual Property
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware and the federal laws of the United States. Trevak's proprietary Multi-Polymer Degradation Engine algorithms, TWSI Thermal Index calculations, and Blind-Run haptic waveforms are protected under US copyright, trademark, and trade secret laws.
